Summaries:

H.2293 and H.2340 attempts to resurrect the discredited idea of creating a ballistics database for every gun sold in the Commonwealth. We note that both are based on a fundamentally flawed concept.

Recently, the Bureau of Alcohol, Tobacco, Firearms and Explosives released a report on firearms that were traced. Although the BATFE carefully indicates that the overall data should not be used to construe crime trends, they do show for those crime guns that were traced, an average “time to crime” of more than 12 years.

H.2342 would place into statute the language of 940 CMR 16.00, the Attorney General’s regulations on handguns. Given the supreme amount of confusion these regulations are currently causing, such a move would be extremely unproductive for the economic health and safety of the commonwealth.
H.2343 would prohibit licensed dealers from transferring so-called “assault weapons” currently lawfully owned under state law, unless the sale was to a law enforcement official.

S1354 Despite its title, the bill has nothing to do with youth, and the term Youth or Minor is not mentioned anywhere in the bill. This bill does attempt, through further regulation of licensed firearms owners and dealers, to address problems caused by persons who have no license.

Of the 21 sections in the bill, two-thirds are specifically aimed at the law abiding gun owner. Specifically, four create new regulations for law abiding gun owners, five create new crimes aimed only at licensed gun owners, and five involve greater data collection on licensed gun owners! S.1354 represents a continued journey along the failed path of placing more regulation on gun owners in a vain attempt to curb crime.

S1383 This bill creates no new penalty for persons who own or sell firearms illegally. The title is a misnomer, because the bill seeks instead to restrict the purchases of law abiding citizens with firearms licenses.

The entire presumption of this bill is that licensed gun owners are guilty of committing crimes, which is not borne out by the facts. The sponsors apparently believe that by controlling sales made by gun owners with licenses, we can somehow affect the firearms being used by persons without licenses. It is a fundamental error in logic that ensures S.1383 would have no effect on reducing crime. S.1383 is a type of “one gun a month” bill hidden under another title.

Below is a letter dated 1/16/08 from the NSSF regarding MA S.2406 "An Act for a Healthy Massachusetts Safer Alternatives to Toxic Chemicals".

Below this letter is the original Legislative Alert from the NRA dated 1/14/08 and following the alert are 2 letters that a customer of ours received from two State Reps.

Re:  S.2406 An Act for a Healthy Massachusetts Safer Alternatives to Toxic Chemicals 

The National Shooting Sports Foundation (NSSF), the trade association for the firearms, ammunition, hunting and recreational shooting sports industry, would like to express our concerns and reservations with S.2406 on several grounds.  Certainly, further scientific research with conclusive results, not hypothesis, is needed before even considering alternatives to lead used in ammunition.   

            S.2406 authorizes the establishment of an advisory committee that would work with the Toxics Use Reduction Institute (TURI) at the University of Massachusetts Lowell to establish a list of toxic substances in Massachusetts. In July 2005, Massachusetts requested that TURI perform an assessment of five chemicals, one of which was lead.  Unfortunately, due to time constraints and a lack of funding TURI failed to produce a scientifically conclusive report dealing with lead and the environmental impacts of its alternatives.  The report ignored not only the potential health risks of the alternatives, but also the economics of replacing lead with other materials.  NSSF along with the Sporting Arms and Ammunition Manufacturers (SAAMI) have worked with the Environmental Protection Agency to create safe and effective management practices for ranges with little or no impact on the environment.  We are afraid as an industry that allowing one group to decide what is feasible based upon past performance and studies will be dangerous to gun-owners throughout Massachusetts.       

            NSSF believes that this legislation would allow the opportunity for a more restrictive policy to be crafted and would lead to a complete ban on lead ammunition that is safely and responsibly used by gun-owners throughout the state. Many anti-hunting groups intent on ending all hunting are attempting to scare legislators and wildlife managers with unfounded claims that there is a significant human health threat to the environment and hunters posed by lead.  Recently, in California anti-hunting groups and radical environmentalists were able to ban lead ammunition in the California Condor range without any conclusive scientific evidence.  Similar groups within Massachusetts will use this California precedent to further their agenda.  Creating a vehicle for this to happen in Massachusetts through S.2406 could have horrific consequences.     

            NSSF, along with GOAL and the NRA, hope to protect the rights of law-abiding citizens, industry, private ranges and sportsmen.  Understanding the possible implications of S.2406 is the first step in this process.

Proposed Bill Could Ban Lead Ammunition in Massachusetts! 

Please Contact Your State Legislator Today!

 

House Bill 783 and Senate Bill 558 (Now Senate Bill 2406 )introduced by State Representative Jay Kaufman (D-15th Middlesex) and State Senator Steven Tolman (D-2nd Suffolk & Middlesex) would create a more restrictive policy regarding the use of "toxic chemicals" in the Commonwealth. Hidden within the proposal from environmental and anti-gun extremists is what amounts to a ban on all common rifle and handgun ammunition. 

"The Safer Alternatives Proposals" will create a program to replace ten "chemicals" with what proponents claim are safer alternatives.  On the top of the list of targeted substances is lead, the common element used to make virtually all bullets.  As proposed, this legislation could virtually shut down all shooting ranges as well as ban the sale and use of lead ammunition for self-defense, hunting and target practice in Massachusetts.  Non-lead alternatives exist for ammunition but are significantly more expensive and, in many instances, have sub-standard performance characteristics.  Shooting ranges already fall under federal EPA regulations concerning environmental impact and recent science and EPA guidelines show that lead ammunition on shooting ranges can be managed without detrimentally affecting the environment. Predictably, this legislation does not account for the serious impacts on shooting ranges and the sportsmen and gun owners who use them.   

Please call or write your State Legislator and respectfully request that the lead ammunition be completely excluded from the scope of the legislation.  This step is essential in order to protect the future availability of ammunition commonly used for self-defense, hunting and the shooting sports in the Commonwealth!  Contact information for your State Legislator can be found at http://www.mass.gov/legis/.

My name is Mike Verseckes and I work for Rep. Frank Hynes. 

Rep. Hynes forwarded the email you sent him regarding the safer alternatives bill and I wanted to get back to you. 

This bill is to study and make recommendations on the use of safer alternatives for certain chemicals - but the main criteria is that is has to be safer and feasible that the current one used.  Despite what environmental studies may show about the effects of lead, this bill would not jeopardize the availability (or composition, for that matter) of bullets and ammunition. 

The language in the bill doesn't give it much in the way of teeth, in that it primarily would be to make recommendations.  Furthermore any additional burden in cost to companies, industries, or products would be contrary to the spirit of the bill, which again is to study whether a safer and feasible alternative exists...I can guarantee that replacing lead in ammunition would be an extraordinary pain to accomplish so that would definitely be left alone.

Dear (Customer's name), 

Thank you for contacting the office to voice your concerns about the Safer Alternatives bill.  Unfortunately, there was a misunderstanding by the NRA when they released their action alert claiming that S558, now S2406 would, in effect, ban lead ammunition.  This is simply not the case.  Having personally read the bill and having received further information (see next paragraph) from the sponsers, please know that the bill need not be amended because it does not ban lead ammunition.  The following defines the bill's intentions. 

"The Safer Alternatives Bill, currently Senate Bill 2406, carefully crafted over the course of several years in a collaboration of legislators, scientists, business leaders, and environmental leaders, does not ban any chemicals.  Instead, it sets up a process, to be administered by the Toxics Use Reduction Institute (TURI) of the University of Massachusetts Lowell, to study chemicals.  These chemicals would be chosen for study entirely by a large, diverse advisory panel, made up of stakeholders from industry, environmental activism, children’s groups, and others.  The chemicals have not been pre-selected.  If it is determined that the chemical in question is harmful to health and/or safety, the next step would be to study whether there are feasible, cost-effective alternatives for each of the uses of that particular chemical.  If there are no feasible alternatives, nothing happens.  If there are, TURI would assist business in phasing in these alternatives.  In sum, even if lead is identified as a harmful chemical and there is no reasonable alternative to lead in bullets, there would be no action taken to current practices and products."
